File Bankruptcy
During the 90-day Ch. 7 process, there is only 2 things to do. We will be with you through the process.
1. Complete 2nd online course at www.DebtorCC.org
2. Attend a brief Interview online with Zoom with your case manager (we will give you the questions they will ask and will be with you, don't worry!). No Court Appearance! We go to Court for you.
Step 3
Discharge!
Success! The court will enter your discharge order and close the case. We will monitor your case and keep you updated. Total time in bankruptcy about 90 days.

FAMILY TRUST: Legal document that puts your assets into a Trust Box. You remain in control of the Trust while alive. Upon your passing, the Trust Box moves to your successor trustee and beneficiaries with lots of tax savings without probate.
PERSONAL WILL: your Will identifies your heirs transfers assets to transfer to beneficiaries with the help with the Trust. The Will and Trust work together to protect your assets.
GUARDIANSHIP: the guardianship document allows you to choose a "backup parent" to raise your children until 18 years old. You get to choose instead of a Court.
MEDICAL DIRECTIVE: Appoints someone to make healthcare decisions for you if you are incapacitated and cannot make decisions for yourself. Otherwise, the doctor will make the choice for you. This includes artificial life support, Do Not Resuscitate, organ donation.
POWER OF ATTORNEY: Appoints someone to make financial decisions for you.

COMMON QUESTIONS
1. What is a Homestead Declaration?
It is a legal document recorded against your home which protects the equity in your property before a judgment attaches. You can only protect one property - your home.
2. What is the amount of equity I can protect?
It varies from County but the minimum is $300,000 and the current amount in Los Angeles County is around $700,000 of equity.
3. What is not protected with a Homestead Declaration?
Homestead Declaration does not apply to tax liens, domestic support obligations (child/spousal support), criminal restitution and foreclosure from your own home loan.
4. Can I sell or refinance my home if there is a Homestead Declaration?
Yes, of course. It is your home - you can sell or refinance anytime. Just make sure to record a new Homestead Declaration on your new home.
5. How long does the Homestead Declaration last?
As long as you own the property or until you file and record a Withdrawal fo Homestead Declaration and claim a new homestead on a new home.
6. What will I receive in the mail?
The County Recorder will mail you back the original document back to you in the mail after a few weeks. Anytime someone checks the preliminary title of your home, the recorded Homestead Declaration will be visible there for everyone to see. It is a public document.
